
A 48-year-old man was convicted of defiling a 9-year-old child and given a life sentence by a Mombasa court.
After hearing the complainant’s testimony, the court declared the defendant guilty “beyond a reasonable doubt” in a case before Mombasa Senior Magistrate Martin Rabera.
Margistrate Rabera deemed the complainant’s testimony to be sufficient for a conviction, according to a statement from the Office of the Director of Public Prosecutions (ODPP) on Wednesday about the decision.
The prosecution vehemently objected to the defense’s request for a non-custodial sentence, claiming that the minor is still experiencing trauma and is receiving counseling.
“The court found that the accused did not deserve a non-custodial sentence,” the ODPP posted to Twitter.
“The prosecution, led by PC Barbara Sombo, had contested the defense’s appeal for a non-custodial sentence, noting the minor’s physical and psychological distress.”
According to the ODPP, the court determined that a harsh punishment was essential to deter future sexual offenders from committing similar offenses.
