Raila Can be Declared President by Supreme Court without a Rerun, Lawyer Kipkorir Explains

The Azimio la Umoja One Kenya Alliance after contesting the presidential results released by IEBC chairman Wafula Chebukati, the battle has now been taken to the Supreme Court where they will seeking to have the results annulled on several grounds.

In the petition that Raila Odinga and his team will be presenting to the seven bench judges at the apex court, include several malpractice during the tallying and the inconsistencies in the figures as presented by chair Wafula. 

The alliance is also going to add weight to their case following the distancing of the four commissioners of IEBC who declined to take ownership of the results as released by Wafula Chebukati. However according to city lawyer Donald Kipkorir, Azimio will be basing it’s case on the several arithmetic errors and prove that Raila indeed won the elections.

In his own view, Kipkorir believes that the Supreme Court has had an inherent jurisdiction to correct arithmetic errors without substantive hearing and if this is proven beyond doubt, then the court can declare Raila Odinga president elect without a fresh elections.

“Our Supreme Court has inherent jurisdiction to correct arithmetic errors without substantive hearing. If AZIMIO seeks the prayer of Correction of Arithmetic Errors & demonstrate beyond peradventure that Baba won, then Baba can be declared President without Fresh Elections.” Lawyer Donald Kipkorir posted.
